Dental hygienist and assistants (other than unregistered assistants) must notify the board of any new address within thirty days of the address change. The notice required under this section of law must be given by certified mail, return receipt requested. These individuals may not practice in this state for more than thirty days after the change of address without complying with this requirement. An unregistered dental assistant, qualified dental assistant-limited radiology registrant, and a qualified dental assistant may monitor patients that are induced into nitrous oxide analgesia if the dentist has provided sufficient training to the dental assistant completed after January 1, 2024. The dentist shall maintain documentation of the training for the duration of the delegation and shall provide documentation of the training to the board upon request. Their monitoring must occur under direct supervision of a dentist.
An RDA may monitor patients induced into nitrous oxide under indirect supervision.
If a registrant fails to renew the license by December 31st of even numbered years, the registrant may not practice dental assisting at their level of regisration (e.g., RDA, QDA, QDA-LRR) until they either late-renew, or are issued a registration through the standard application process. It is illegal to practice dental assisting duties without a valid license (except for the duties that may be performed by unregistered dental assistants).
Within 60 days after December 31st of the even-numbered year, an expired registration may be late-renewed by submitting the renewal application, the application fee, late fee and proof of continuing education. If the assistant does not late-renew by March 1st, they must follow the application process explained in NDAC 20-03-01-05 in order to return to their level of practice.
Applicants who meet the criteria of a military member or military spouse may be registered through the process set forth at NDCC 43-51-11.1
A CDA is not a title or endorsement provided by the Board. Instead, individuals earn a CDA by passing the Dental Assisting National Board's "Certfied Dental Assistant" examination. To achieve that certificaiton, the individual must meet all requirements put in place by the DANB, including passage of their Radiation Health and Safety (RHS) exam, Infection Control (ICE) exam, and the General Chairside (GC) exam. Those who hold a DANB CDA must first register with the Board before carrying out any duties in North Dakota beyond those of an Unregistered Dental Assistant.
According to laws governing reporting, a licensee must report to the Board in writing within sixty days of the event any arrest, illegal, unethical, or errant behavior or conduct, including malpractice judgements or settlements or final judgment, a final disposition by a licensing agency in another state, territory, or country; all proceedings, of formal or informal actions by a governmental agency; a law enforcement agency; or a court for an act or conduct that would constitute grounds for discipline. Such matters must also be reported in an initial applicaiton and when renewing a registration.
